California Proposition 65 is a “right to know” law passed in the mid‐1980s to address growing consumer concerns about exposure to chemicals that may be present in consumer products. The law requires California to publish a list of chemicals known to cause cancer, birth defects or other reproductive harm. Businesses are given 12 months to comply with the Proposition 65 warning requirements after a new chemical is added to the list or be subject to risk of litigation from California’s enforcement community.

NSF offers full Proposition 65 services, from analytical capabilities to generating the required data to full dossier assembly.

We may be able to leverage client data (such as product types and product formulations, which are useful for exposure calculation) from testing already completed in support of NSF certification or registration.

How the Process Works

Customized to your project requirements, our Prop 65 projects typically follow these steps:

  1. Formulation review: NSF toxicologists perform a comprehensive review of formulary information and raw material composition disclosures for the presence of Proposition 65 listed chemicals.
  2. Exposure assessment: NSF toxicologists conduct an exposure assessment and determine whether exposure under specified use conditions is anticipated to exceed safe harbor levels.
  3. Safe harbor levels development: If safe harbor levels are not established for a listed chemical, NSF toxicologists can derive them according to the guidelines established by the California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment.
